Welcome to www.shoplebanon.online (the “Site”). We, DHL International B.S.C. (c), a company incorporated and existing under the laws of Lebanon, with registered office at Beirut (Lebanon), registered at the Lebanese Chamber of Commerce under number 48757 (“SNAS (Lebanon) S.a.r.l.”), hope You will enjoy using the Site. These terms and conditions explain DHL’s obligations to You and Your obligations to DHL, and they govern Your use of the Site. You acknowledge and agree that You have read them and will comply with all of these terms and conditions.
 
  1. The Terms 'You', 'Your', 'We' and 'Our'
In these terms and conditions, the terms 'You' and 'Your' refer to you personally (if you are an individual) or the entity you represent or you are acting on behalf of it, and the terms 'We' and 'Our' refer to DHL and/or its third party suppliers.
 
  1. Acceptance
You agree that You are legaly entitled to use the Site, and that by using this Site you accept the present terms and conditions which are equivalent to signing a hard-copy agreement between You and DHL.
 
  1. Warranties and representations
You warrant and represent that:
  1. You are legally capable and authorized to accept these terms and conditions, and if you represent an entity, all actions necessary to authorize You to accept those terms and conditions, have been taken;
  2. You are at least eighteen (18) years old or the legal age of majority in Your country of residence; and
  3. You will use the Site only for lawful purposes and in accordance with these terms and conditions.
 
  1. Use of the Site
You may not use the Site for any unlawful purpose. We reserve the right to terminate and/or restrict Your access and use to the Site if, in Our opinion, Your use may violate any laws and, infringe upon another person's rights, breach these terms and conditions or any other legislation/regulation/policy applicable to DHL.
 
The Site is designed in order to allow You to connect with merchants based in Lebanon to purchase their merchandise directly via their websites (the “Merchant Websites”). Nothing in the Site is designed to create a sales agreement between You and DHL. DHL assumes no liability in respect of You accessing or using the Merchant Websites and makes no representation in respect of the products and/or services sold on the Merchant Websites.
 
  1. Malicious content
DHL cannot and does not warrant the absence of viruses, worms, and/or other malicious contents on the Merchant Websites pages. We therefore advise to take appropriate safeguards before downloading information from the Merchant Websites.
 
  1. Intellectual property
The Site, including its user interfaces, 'look and feel’, its content, all associated and underlying software, the data generated by the software, know-how, methodologies and processes are and will remain the sole property of DHL, and are protected by intellectual property laws. The use of the Site, including the aforementioned, is licensed to You by DHL on a nonexclusive and limited basis:
  1. You may not copy, reverse engineer, decompile or create derivative works from the Site;
  2. You may not use any meta tags or any other 'hidden text' which incorporate DHL’s name or trademark unless We give Our prior written consent;
  3. While You are using the Site, You may print out or electronically store any of the web pages or screens on the Site but solely for Your personal use;
  4. You may not scrape, frame or display information from the Site for use in another website or service without Our prior written consent;
  5. You may not place a hyperlink to the Site on your website unless We give Our written consent and following Our instructions; and
  6. You may not violate any intellectual property law when using the Site.
 
  1. Intellectual property infringement
DHL is taking any reasonable measures to respect intellectual property rights of others, and DHL is making any reasonable efforts not to publish any material that is subject to third party copyright, trademark or other legal protections. If You believe any material on the Site infringes your intellectual property rights, please inform us by submitting an infringement complaint.
 
  1. Trademarks
The name 'DHL' is a trademark, with registrations granted in numerous countries. Use of the Site does not grant You a license or any other right to use the DHL trademark. The DHL trademark may not be copied, downloaded, reproduced, used, modified or distributed in any way without Our written permission. All other trademarks and/or trade names displayed or referred to on the Site are the property of their respective owners.
 
  1. Other websites
DHL is not responsible for the content or accuracy of information obtained from any third party website or Merchant Website which may be linked to the Site, or which you may access from the Site.
 
  1.  Disclaimer of warranty
Your use of the Site is at Your own risk, and You acknowledge that the Site is provided on an 'as is' and 'as available' basis. While We endeavour to provide accurate and current information via the Site, We disclaim all warranties, express and implied, including but not limited to warranties of merchantability, fitness for a specific purpose, and non-infringement, to the full extent permissible by applicable law. The Site is not warranted to be uninterrupted or error-free.
 
  1.  Limitation of liability
In no event will DHL be liable for any direct, indirect, special, consequential, incidental, punitive or exemplary damages (including but not limited to loss of business, loss of revenue, loss of profits, loss of goodwill, lost opportunity, business interruption, or loss of information) arising out of following You accessing the Site.
 
  1.  Ordering products
In the case You place an order on a Merchant Website, You agree to comply with any conditions and restrictions of sale which are specified on the Merchant Website or which You are notified of during the purchase process.
 
Via the Site, DHL enables You to shop online from Merchant Websites and have products delivered to You in Your home country. However, DHL does not sell the products to You. You are solely responsible for selecting and ordering the products from a merchant, and Your purchase of a product is a transaction solely between You and the merchant. DHL is a third party to this transaction.
 
DHL makes no representations, warranties or guarantees regarding the quality or suitability of the products You order on a Merchant Website. DHL has no liability for any failure of a merchant to ship to You or to fulfill Your order, or for any defects in any product You purchase, or any injury or damage that any product may cause, or for any other failure of the product to meet Your expectations.
 
If after delivery to You, You would be of the opionion that a product is defective or does not otherwise meet with Your expectations, You agree that You will hold DHL harmless from any liability and will seek any remedies solely from the merchant.
 
  1.  Indemnification
You agree to indemnify, defend and hold DHL and its shareholders, officers, directors, affiliated companies, employees, agents and any other person/entity DHL might see fit, harmless from all claims, losses, damages, liabilities and costs (including attorneys’ fees) incurred by DHL and all its corporate affiliates and companies which result from Your use of the Site.
 
  1.  Entire agreement
These terms and conditions (or as they may be modified from time to time) constitute the entire agreement between You and DHL for the use of the Site. Any other written or oral statements are superseded and of no effect.
 
  1.  Partial invalidity
If any provision of these terms and contitions is judged by a court or body having jurisdiction as illegal, invalid or unenforceable, such provision will be deemed deleted without affecting any other provision.
 
  1.  Waiver
If either You or DHL fails to enforce any provision of these terms and conditions, or fails to exercise any right at any time, such failure will not be deemed a waiver thereof.
 
  1.  Disputes and governing law
These terms and conditions shall be governed by, and interpreted and construed in accordance with the laws of the Kingdom of Bahrain. Any dispute arising under or in any way connected with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Bahrain.
